PROGRAM OWNERSHIP / DISTRIBUTION

A. Ownership/Copyright

1) Public Access Programs

Public access producers retain ownership of the creative rights to the programs they produce, and may register and establish a copyright at their discretion.

2) For-Hire Productions

Works created for CTSCC, either through a contract, employment arrangement, or volunteer barter/training arrangement, including outreach productions, shall be the property of CTSCC.

B. Intention

Programs produced with CTSCC equipment and facilities must be intended for cablecast on a CTSCC channel, except under special circumstances approved by the Board or Executive Director of CTSCC. Any special circumstances approved by the Executive Director will be recorded in writing and presented to the Board of Directors.

C. First Use

Any program produced by a user with CTSCC facilities and/or equipment must be cablecast at least once on a CTSCC channel prior to, or concurrent with, cablecast on any other cable or broadcast system, and prior to any other form of distribution unless excused from first use by the Executive Director, who shall record the decision in writing and report it to the Board of Directors. Once a program is submitted for scheduling it may not be removed from the premises without the permission of CTSCC staff.

D. Acknowledgment of Access Facilities

All programs produced with CTSCC equipment and facilities, and any copies, must clearly acknowledge the provision of the equipment and facilities. The following wording is the minimum requirement:

"This program was produced utilizing the resources and facilities of Community Television of Santa Cruz County.

E. In-House Distribution

By requesting access to equipment, facilities, and playback, access producers agree that CTSCC may use portions of their programs for non-commercial, promotional purposes or for purposes of entering in community programming festivals.

F. Dubbing

Dubbing services are available for copying community access footage and programs produced with CTSCC equipment and/or facilities.

Videotapes of acceptable quality for dubbing may be provided by the access producer or may be purchased from CTSCC. Copies ("dubs") produced using CTSCC facilities may not be used primarily for commercial purposes or the solicitation of funds except as provided by the Board of Directors.

Limited dubbing services are also available to government agencies and educational or nonprofit organizations depending upon available staff and equipment resources. Requests for dubbing videotapes other than community access productions must be approved by the Executive Director.

1) Initial Copy

The access producer is entitled to one copy of a completed access program without a dubbing charge. The producer may be required to perform the labor and pay for the tape stock for such dub.

2) Cablecast Copy

If the access producer chooses to make a "cablecast copy" for playback on CTSCC channels, a dubbing fee will not be charged for making one copy of a master tape.

3) Additional Copies

Dubbing fees will be charged for any additional copies, after the initial copy and the cablecast copy, in accordance with established videotape dubbing rates.

4) Dubbing by Access Producers

Access producers may dub one initial copy and one cablecast copy of their access production during their scheduled facility time. Staff may authorize one additional copy without charge depending upon equipment availability. Any additional dubbing will be subject to established videotape dubbing rates.

5) Third Party Charges for Dubs

An access producer may not charge third parties for use of access equipment, facilities or channel time as part of dubbing fee.

6) Dubbing/Distribution of Raw Footage

Dubbing or outside distribution of raw footage or programs produced using CTSCC facilities or equipment may be performed with notification of CTSCC of the intent to distribute such program or production, or to enter into a sales distribution agreement. In the event of such an agreement, CTSCC shall receive fifteen percent (15%) of all monetary transactions totaling over one hundred dollars ($100) per production.

7) Dubbing Raw Footage for Logging/Scripting

Dubbing of one copy of raw footage to allow logging and scripting of tapes is permitted.
